Office attack victim appeals records ruling

Associated Press Published:

COLUMBUS -- A man injured after he was repeatedly stabbed at an Ohio office building last year is appealing a judge's ruling denying him copies of the suspect's mental health records.

Stabbing victim Jeffrey Maloon says suspect John Mallett suffered from severe mental illness, including schizophrenia, and was prone to "violent assaultive outbursts" when living in Tennessee before coming to Columbus in January 2012.

Attorney Michael Rourke says Maloon needs the records to determine whether mental health providers in Ohio or Tennessee could be sued over Mallett's treatment.

The appeal case was sent to the 10th District Court of Appeals in Columbus on Monday following a decision by Franklin County Judge Kimberly Cocroft last month that said the victim doesn't have standing to receive the records.
