CLEVELAND -- Testimony of several experts are expected to highlight a sentencing hearing for the owner of a northeast Ohio oil and gas drilling company accused of dumping large amounts of toxic brine down a storm sewer and into a creek that feeds the Mahoning River.
Federal prosecutors are seeking a three-year sentence and a $250,000 fine for 64-year-old Ben Lupo when he is sentenced on Tuesday in federal court in Cleveland.
Lupo of Poland, Ohio, pleaded guilty in March to one count of unpermitted discharge into U.S. waters.
The (Youngstown) Vindicator reports that at least three expert witnesses are scheduled, including the Ohio Environmental Protection Agency's on-scene cleanup coordinator, a forensic chemist and Lupo's personal physician.
