Portage County Prosecutor to decide if charges filed in Atwater shooting

Authorities are wrapping up their investigation into the shooting death of an Atwater man on Jan. 13, and it is up to the Portage County Prosecutor's Office to consider filing charges.

Kevin M. Bailey, 32, with a last known address of 1425 Whittlesey Ave., was shot and killed at 2211 Alliance Road at about 2:30 a.m.

Portage County sheriff's detective Lt. Greg Johnson said he has forwarded the results of his investigation to the prosecutor's office. Prosecutor Victor Vigluicci said he is waiting on Bailey's autopsy report from the Summit County Medical Examiner's Office before making a ruling.

The alleged shooter in the case is cooperating with authorities. He was not arrested and remains free pending Vigluicci's decision.
