Sheriff's detective put on paid leave Jack Herman out of work during investigation into charges he plagiarized play

A Portage County sheriff's detective is on paid administrative leave pending the outcome of an investigation into charges he plagiarized at least one and possibly more plays written by a Canadian playwright.

In a controversy spanning two countries, Jack L. Herman, the detective in charge of Portage County's concealed carry weapons permit program, was reported in several media outlets to have stolen the work of Canadian playwright David Belke and claimed it as his own while Herman was president of Kent's Tree City Players theater group.

Herman, the Tree City Players and several other community theatre groups put on productions of "The Unexpected Return of Sherlock Holmes," a play Herman claimed to have written, between 2000 and 2005.

Only, Herman didn't write it. Instead, he bought a copy of Belke's play and five others -- but not the rights to produce it -- from the Playwrights Union of Canada in 1999, changed the name and touted it as his own, according to the Edmonton Journal and those whom Herman allegedly plagiarized.

Portage County Sheriff Duane Kaley said he first heard of the allegations Wednesday when contacted by a reporter. Putting Herman on paid leave is "standard" under the circumstances, he added, "until we have an opportunity to really find out what's going on."

"I had no idea if it was occurring, if in fact it did occur," Kaley said. "We're certainly going to inquire into it to see. I just don't know all the facts of it, because I'm going off what the news media has told me."

Kaley also said he has yet to speak with Herman's accusers, though he spoke to Herman "briefly" Thursday and said he's "sure we'll be having conversations of a more in-depth nature."

Herman could not be reached for comment.

"The Reluctant Resurrection of Sherlock Holmes" is a mystery in which the ghost of fictional detective Sherlock Holmes haunts his creator, Sir Arthur Conan Doyle. It was written in 1992 by David Belke, an Edmonton, Alberta actor, producer and playwright, according to the Edmonton Journal.

The newspaper reported this week that Belke and his agent were informed of similarities between the two works last year by a Maryland-based Sherlock Holmes fan. Acting as their own detectives, they contacted Bill Wolski, whose Coconut Productions theater company was set to perform "The Unexpected Return of Sherlock Holmes" in September 2006 in Los Angeles.

According to the Edmonton Journal, Herman paid $2,500 to Belke and his literary agent to settle the matter out of court. Herman's attorney, David Sed of Ravenna, did not return a phone call seeking comment.

A message seeking comment was left Thursday for Wolski, a Cleveland native and friend of Herman's who moved to Los Angeles from Northeastern Ohio in 2002. In a posting at www.billwolski.com, Wolski explained that he canceled the recent production because "it has come to the attention of Coconut Productions that 'The Unexpected Return of Sherlock Holmes' is a plagiarized work."

"We are voluntarily shutting down our production with the hope of restaging the piece in the near future, this time giving proper credit where due" and under Belke's title as "The Reluctant Resurrection of Sherlock Holmes," Wolski said on his Web site.

The Edmonton Journal also printed accusations, which Herman denied in an interview with that newspaper, that he put his own name on two other works -- Ontario, Canada playwright Kim Selody's "Suddenly Shakespeare" from 1988 and "I'll Be Back Before Midnight" by Peter Colley, which the Toronto Globe and Mail called "the most popular stage play in Canadian history" and one later made into "Illusions," a 1992 cable TV movie.

Herman is said to have changed only minor details in the plays, from the first name of a character in the Sherlock Holmes play to reworking the title of Colley's play to "Before Midnight!"

Herman told the Edmonton Journal he was just trying to keep the Tree City Players afloat.

"I am ashamed of what I did. I have done what I can to try to make restitution financially to Mr. Belke. I have personally apologized to him and I would like to see the matter put to an end at this time," he said, according to the Canadian newspaper.

The Tree City Players formed in 1995. In 1999, the community theatre group opened their own theatre at 124 E. Main St. in Kent. It later closed, and the Tree City Players found a new home at The Kent Stage when that venue opened in 2002.

Tom Simpson, the manager of The Kent Stage who has worked with Herman in the past, said he doesn't believe the Tree City Players put on any of the allegedly plagiarized works at the theatre. He said he was "definitely surprised" by the allegations and had "absolutely no idea" Herman was using the work of another playwright.

Former colleagues and others who know Herman and were contacted by the Record-Courier expressed shock at the allegations, but most had no comment.

Herman himself previously told the Record-Courier he had an interest in Kent having its own community theatre.

"I'm from Kent, and I've always wanted to start a theater group in Kent," Herman said for a June 14, 1997 article on the Tree City Players. "Kent's got a wealth of talent, and I thought, 'Why not?'"

Samgolf- it's tricky business to judge the intent of someones words.

there is an old adage that states "we receive where we're at"...

sometimes our perseptions and responses tells us more about ourselves than the other person--Now Im not insinuating this pertains to you : )
Im just sharing information I've read.

My question would be - even if this woman NO Kool Aid -excuse me Kool Aid you already cleared up that you are not a woman but a man ; )
my question wouold be - even if the speaker or writer is bitter, or hurt, or angry or in any other state one cares to describe , does that make the questions irrelevent ? does it somehow sully the truth ?

sometimes people have to become 'fighting mad" in order to speak up. sometimes they have to be hurt or victimized personally before they "get it" and have the energy or the concern to become involved or active Against things that they see as harmful to all of us. or on the other side of the coin become active and outspoken For things they believe in. Kevin Poland is in the public eye (he and I have had this discussion) He is a grown and capable man who understands that being an elected official means he will be sometimes criticized, as well as complimented. He will be challenged, and questioned. he can handle it. The mayor of a city is working for the entire city that means allies and critics alike. I really am glad this site exists and that people are using it - regardless wether I agree or disagree with their positions. It is a good thing for the community and I have directed compliments to the Record Courier for providing it . I have also been critical of some of the reporting or in my perception lack of reporting on various issues.
another question would be -havent you seen more ink given some people than others by the paper. Even when the least ink article is about more major misdeeds? I know one might say well major or minor is just a matter of opinion- is it?

We go to school and learn critical thinking --- now thats very different than simply criticizing something or someone because we just dont like them or dont like what they say. We are instructed how crucial it is to be a critical thinker(meaning to consider the thing from various points of view) to our system and our way of life--then when we exercise it we are put down and criticised ??? we get this in many areas of life, seems crazy to me ...but maybe Im just receiving where Im at ; ) My point -- Ravenna has had some major problems for a very long time -- they need addressed. The paper prints what it prints and some people may think they should do more- the detective has been accused of wrong doings and will have to answer to it - Jones got caught in some of his crimes and will now do the time- stone did some crime and he has to deal with it - some believe that what was discovered with jones is but the tip of the iceberg. Some people think that certain people get dealt with softly on serious felonies and others bashed and destroyed on more minor matters. Such is life one might say but others refuse to accept it. So here is the forum where we can speak our mind and hearts- where we can remind ourselves, one another, and our elected officials that we are accountable to one another. No one is above the law- steven segal made a movie about it (sorry) or are they? - to some that remains the question...

Everyone has their favorite gripe. I had hoped that the Jones thing would finally die with the primary. guess not. Smoking in bars? Totally unrelated to this story. No matter what the topic some always want to bring it back to their issue.

Are other issues important? Of course! But a story about a local resident with international implications is news and should be reported.

PS for the bar owner, the reason you can not simply put up a separate building is because the law is intended to protect the workers in the bar along with the patrons. Anyone following this issue was aware of this, nothing was hidden. You sound like you just don't like the law.

My words are just words until they have substance. My mere words should not bother you. They should not harm Mr. Poland. If he will be a good Mayor you shouldn't have to tell people. It should have already been obvious by now.

As for the "bitterness" you feel you see in my writings, well, bitterness perhaps is just love disappointed. It may be you see my disappointment in good people allowing bad people do bad things to people under their control. I find them equally culpable.

I understand if you just call me bitter or blame me then Poland gets to hide behind the blame. It's always safest behind blame. It's difficult to come out and debate. All the Politicians say blame Jones, not me! If you stand there while a child gets abused and say nothing, you're to blame as well. Jones went after people! Went after their wives. Humiliated people, They sought out to destroy people. Maybe you don't know. But I know some that do and they are in City Hall!

We shall see what type of Mayor he is, but he is a fabulous person... Not a nicer guy exists.

But see this ain't about picking a nice guy to play "bean bag" on a Sunday afternoon. This is about real people and real issues.

A good Mayor would recognize when it's time to heal some wounds in a city that has been through a lot.

A good Mayor would be horrified by what happened and be frantically finding ways to root out the corruption and put some sunshine on it.

A good Mayor would show up at Jones hearings to support the City and send him to jail as a symbol of solidarity. Why couldn't he show his face to Jones?

A good Mayor would find who was hurt in the city by the criminal acts and abuse of power by Jones and open an investigation so there is more sunshine.

A good Mayor would allow the citizens to speak about problems without being gaveled down by hacks.

A good Mayor would work with the school system to make sure the transition to a brand new school will go without a hitch and would present a plan to brag about our new school to bring in residents (taxpayers) businesses (jobs - Thus taxpayers).

Where was his plan again? I missed it...

We shall see my friend SamGolf, and we shall see if the Record Courier works as hard to ask Deputy Hermann questions and holds him to the same standard they held Poland to during the Primary/coronation. They're about to bury him. He will lose his job, he will likely have to pay damages, but the R/C will now bury him. I'm not saying that's right or wrong, I am saying they ran out of questions for Poland. Different standard for the power brokers. The Hypocrisy of it is actually funny...

You should be thankful you don't know what happened to a lot of people during Jones...Yet...

I am asking for more sunshine, yet I am bitter. I am asking for more openness, yet I am bitter, I am asking him not to hide, yet I am bitter. I want Ravenna to be an open book, yet I am bitter. I want us to heal once and for all and I know the only way is the acknowledge what happened, yet I am bitter.

For Jack Hermann. You screwed up big. You owned up to it. You will pay a price. But, it does not have to define you unless you let it. All the good you have ever done will not be reported here, most people will dwell on the bad, but a real man owns up to what he's done, makes amends to people hurt and moves forward. It's up to you where you go from here and whether this defines you or not is up to you.

Hmmm... let me see... people drinking alcohol, getting drunk, starting fights, driving AWAY drunk, the peripheral effects of drug usage, girls dancing on tables, girls getting taken somewhere and...(oops - almost commenting on the wrong story there)...

I saw that owning a bar was a headache from a mile away. You are a dying breed, my friend. Sell, sell, SELL!!!

Hey Jack, sorry to see you're in the spotlight over this and the R/C seems to be all over you like white on rice. Funny how things happen. But, this is way more important than a Mayor going to prison after he systematically defrauded the city. And you know what's funny Jack? That Mayor??? You know Jones??? He did all this over many years without a single solitary politician knowing he did it. You know what else Jack? They are now relaxed and no ones asking any questions at all.. Hell, we haven't even heard anything about the Stone investigation. Funny how no one else knew about that while it was going on either...

I have a suggestion for you buddy. Give a lot of money to the most relaxed politician you see in the city of Ravenna, but don't ask him any questions, he gets upset. Then ask to have your case investigated by RPD. The R/C will then stop asking questions but it may take them up to 24 hours to get the word. I am told if you act now, you can get free lawn mowing, firewood and snow plowing from the city (restrictions apply and while supplies last) (City of Ravenna corruption is a trademark and not to be used by any other source without the direct permission of the Mayors office or by contacting the Department of Federal Prisons)

Just asked to be held to the same standard they hold themselves to... If that happens, you'll be just fine!

PS. Don't be mad at the R/C for getting scooped by the Plain Dealer. The R/C has an extra step they have to take when looking into the story. They have to check with some local politicians to make sure it's okay to take him out. And with him out relaxing, it may have taken some time to get the okay...

Pliny let me assure you, I don't think this is a joke. I am just surprised that it is front page news when there are so many other newsworthy stories that could be should have been there.

If someone steals your work, you should absolutely be compensated. Just like someone that is stealing my business. I am a partner in a small local bar. I made a modest living. I'm not rich by no means. The voters spoke and they wanted no smoking anywhere, through a misleading ad campaign that was fueled by the states greed for money from the lung assoc. and the cancer society. It was a bad law to begin with. Not finished before it was introduced nor passed. It should have had a provision where I could build an enclosed area for smokers inside of my building. That's all we wanted. to keep my customers comfortable and prevent them from hanging out outside in front of the building smoking. Now they want to raise taxes because the state didn't take into consideration that they had to enforce the law. It was haphazard, shoddy work by our politicians and now my dream of 25 years will probably go up in a cloud of dust. As will my $400,000 investment. Also ask my 7 emoloyees, who made very good money, how they feel now that they aren't making money and will have to find new work. To add insult to injury there is now a commercial on the radio and tv that says this is not hurting our sales. Guess what B#^$ S%#^. I usually have 60-70 people in my place at 11:00 on a Thursday. Want to know how many I had last night...4. I has been slowly decling since the law went into effect. The only thing that changed... this law. They say the business will come back... until then who is going to pay my mortgage, the gas, electric etc? Who will pay my employees bills? Just lies and no representation for me. A person that is creating jobs, tax revenues for the city state and country.
The bad thing is I'm no the only one in this position.
