City of Kent must pay $130,000 to 11 arrested in 2003 protest

The City of Kent has been ordered to pay $130,000 to 11 people arrested May 4, 2003 during a protest against the Iraq War, based on a federal court's decision that the city violated protesters' rights, according to a statement from an attorney representing the protesters.
Plaintiffs in the lawsuit alleged the city and the Kent Police Department targeted leaders of the antiwar demonstration without regard to whether they violated any laws.
Kent city officials confirmed a court-ordered settlement, but not the amount of $130,000 and declined further comment. Arizona-based Scottsdale Insurance Company represented the city in the case, but an agent with the firm would not release details of the settlement. It is unclear if the city will appeal the ruling.
Attorney William Whitaker of Akron, who represented the protesters along with attorneys Nancy Grim and Andrea Whitaker, released a statement Tuesday confirming the settlement amount. The United States District Court has entered an offer of judgment against the city"because the arrests were made without probable cause," according to the statement.

I disagree DZD, I can guarantee you I don't agree politically with a single person in that protest, but they didn't deserve to be arrested...

Did you see that a federal judge said? "Arrests were made without probable cause." This is fundamental! This happens EVERY DAY in this area! Every day! Most people just don't go to Federal Court about it...

See, here's the problem... The police are getting away from using the law as their guide. Most don't know the law and now Kent is paying the price for it...

There are reasons to arrest people in Ohio and there are only a few reasons to arrest without a warrant. Otherwise, a citation is the only summons you can issue, unless you get a warrant. Pesky law... There are police who threaten jail so they can search a person or their home/vehicle.

Ravenna Police, who are the worst offenders, the dog guys threaten all kinds of illegal threats to search people and cars. Those threats never seem to make the police report though... People reading this have heard those threats...
The Detectives and Administration will find the crime first, then fit you to it the crime later (I know some of you are having a hard time getting that, but it's true), and I mean later, after a ton of money spent on both sides, we find the person not guilty. And now, the City of Kent (taxpayer) in this case, has to pay them damages... GOOD, now follow the law!

I find it troubling that many people look at the ends and not the means. In other words, you disagree with the protesters so "screw em" "throw them in jail..." Is that the world we want to live in?

The Constitution gives us the right to peacefully assemble and protest. Its evolved to getting a permit, having to be so far away from the area no one can hear the protest, so where's the freedom in that? But, most people don't know what the Constitution is and those that do don't follow it unless we agree with the end result. Now it's just a paper with dead men's signature on it. We give it power or we can kill it...

Liberty in this country seems to be a fairytale told to us by once great men who believed in the power of personal freedom. If only we could resist voting for our own personal self interest and vote the good of the Nation we might survive they thought. Now we have government putting cameras at every street corner sending out automated traffic fines, police boarding your boat without cause and counting your fish when you're fishing with your children, fences and gates everywhere and no one seems to mind being searched whenever the government decides it's for your own good. All this while the government won't allow good Americans to protect their families or their property from criminals. Alas, The Preamble to the Constitution should now be changed from "We the People" to "Once upon a Time."

Use the law and not your power...
