Ravenna Twp. man gets 2 years for fracturing jaw Sentence stems from July 2009 argument, assault

A Ravenna Township man was sentenced to two years in prison Monday for fracturing a friend's jaw during a July 15, 2009 argument and assault that left the victim with lingering injuries.

Scott A. Shute, 31, of 4364 S. Prospect St., received the sentence from Portage County Common Pleas Court Judge Laurie Pittman. He had faced up to eight years on a charge of second-degree felonious assault, but prosecutors suggested the minimum sentence of two years based on Shute's Dec. 3 guilty plea.

Prompted by Pittman, Shute tried to apologize to the victim, Andrew Hribar.

"I'm extremely sorry for my actions," he said, turning to face Hribar in the courtroom. "Andy, we were good friends."

"I have no feeling in the left side of my face," Hribar responded. "No, I can't take your apology."

Shute was ordered to begin serving his sentence immediately. He was handcuffed and led out of the courtroom by a Portage County sheriff's deputy. Pittman also ordered him to pay $1,175 in restitution for medical bills incurred by Hribar and fined Shute $500 plus court costs.

Shute was arrested by Ravenna police after he and Hribar got into an argument about a television. Shute had accused his friend of stealing his television, Portage County Prosecutor Victor Vigluicci previously said, and punched Hribar twice in the left side of his head.

Hribar fled the altercation and sought help from Ravenna police. Medical treatment revealed Hribar had a fractured jaw that required facial surgery, including the removal of teeth and the insertion of plates and screws.
